Greenbelt Law
Preferential treatment: The assessed value of eligible property is based on the income, soil productivity, topography, and other factors that determine anticipated agricultural or forestry income. The annual agricultural income estimate for a parcel of open space land is the same as that for the least productive type of agricultural land. The assessment ratio for Greenbelt property and residential property is 25%. Commercial and industrial properties are assessed at 40%.. Penalty: When Greenbelt property is disqualified for any reason, the owner is liable for a rollback assessment of repayment of the taxes saved while the land was classified as Greenbelt. The rollback period is 3 years for agricultural and forestland, 5 years for open space land, and 10 years for land under an open space easement. The owner may be liable for rollback if the property no longer qualifies for Greenbelt, including failure of a new owner to apply in the new owner's name, the owner requests in writing that the classification be withdrawn, property covered by a recorded subdivision plat (or any portion thereof) is developed, the property is sold and the land is converted to a use other than Greenbelt, or the land exceeds the acreage limit. However, foreclosure on the property will not result in a rollback assessment unless the property is used for purposes other than Greenbelt.. Eligible land uses: Agricultural/Farmland, Conservation/Open Space, Forest Land/Timber Production. Eligibility: Plot/Land Size, Income Production, Management Plan, Other Eligibility Requirements. Plot criteria: No person may place more than 1,500 acres of land within any 1 taxing jurisdiction under Greenbelt statutes. To be eligible as agricultural land, a property must meet 1 of the following requirements: (1) consist of a single tract of at least 15 acres, including woodlands and wastelands; (2) consist of 2 noncontiguous tracts within the same county, including woodlands and wastelands, 1 of which is at least 15 acres and the other at least 10 acres and together constitute a farm unit; or (3) property consists of 2 noncontiguous tracts within the same county that total at least 15 acres, including woodlands and wastelands, that are separated only by a road, body of water, or public or private easement and together constitute a farm unit. Forestland must be engaged in the growing of trees under a sound program of sustained yield management or consist of a tract of 15 or more acres having tree growth in such quantity and quality and so managed as to constitute a forest. Forest land must: (1) consist of a single tract of at least 15 acres or (2) two noncontiguous tracts within the same county that total at least fifteen acres that are separated only by a road, body of water, or public or private easement and together constitute a forest unit. Open space lands must be at least 3 acres. Open space includes Greenbelt lands or lands primarily devoted to recreational use.. Income criteria: To qualify as agricultural land, farm property should normally produce an average annual gross farm income (including farm sales, farm rent, or federal farm support payments) of at least $1,500 over any 3-year period.
