Farmland Development Program
Preferential treatment: Under a farmland development rights agreement, the landowner is entitled to a credit against state income tax liability. The credit is the amount that the farmland property taxes exceed 3.5% of household income. This credit is added to a homestead property tax credit which the landowner may claim on the state income tax return.. Penalty: Upon the termination of all or a portion of the development rights agreement, the landowner must repay the last 7 years of credits attributable to the land. The state land use agency shall prepare and record a lien, if any, against the property formerly subject to the development rights agreement for the total amount of the allocated tax credit of the last 7 years and 6% interest. Repayment on termination or release due to death or disability uses a formula that prorates the 7 years of tax credit and no interest is included. If the owner changes the use of the land without the permission of the state land use agency, he or she may be subject to a civil penalty for damages that cannot more than double the value of the land at the time the application for classification was approved. Eligible land uses: Agricultural/Farmland, Other Land Uses. Eligibility: Plot/Land Size, Income Production, Multi-Year Commitment, Other Eligibility Requirements. Plot criteria: For farms of more than 5 acres but less than 40 acres, more than 51% of the land must be in active agricultural use and the annual gross income earned from agriculture must be at least $200 per acre of cleared and tillable land. For farms 40 acres or more, under 1 owner, at least 51% of the land must be in active agricultural use. Specialty farms designated by the Michigan Department of Agriculture must be at least 15 acres and have a gross annual income in excess of $2,000 per year.. Income criteria: For farmland less than 40 acres, in 1 ownership the agricultural land must produce an income of at least $200 per tillable acre. Farms, with 40 or more acres, in 1 ownership, must have a gross annual income in excess of $2,000 per year. A farm designated as as specialty farm in 1 ownership must have produced a gross annual income from agricultural use of $2,000.
