Farmland Tax Law
Preferential treatment: The municipal assessor, chief assessor, or State Tax Assessor for the unorganized territory shall establish the 100% valuation per acre based on the current use value of farmland used for agricultural or horticultural purposes. The values established must be guided by the Department of Agriculture and adjusted by the assessor if necessary based on considerations as farmland rentals, farmer-to-farmer sales, soil types and quality, commodity values, topography, and other relevant factors. These values may not reflect development or market value purposes other than agricultural or horticultural use. The municipal assessors adjust the 100% valuations per acre for farmland for their jurisdiction by the ratio or percentage of current just value that is applied to other property within the municipality to obtain the assessed values. The State Tax Assessor adjusts the 100% valuations per acre for farmland for the unorganized territory by the ratio or percentage that is used to determine the state valuation applicable to other property in the unorganized territory to obtain the assessed values.. Penalty: The penalty is the recapture of the taxes that would have been paid on the land for the past 5 years if it had not been classified as farmland, less all taxes that were actually paid during those 5 years, and interest at the rate set by the town on delinquent taxes. If the owner fails to report a change in land use, the owner shall pay an additional penalty equal to 25% of the standard penalty. There is no penalty if property changes from farmland classification to open or timberland classification if the parcel meets eligibility requirements of the new classification.. Eligible land uses: Agricultural/Farmland. Eligibility: Plot/Land Size, Income Production, Prior Year's Land Use. Plot criteria: To be eligible, the farmland must be at least 5 contiguous acres. No person can apply for classification for more than an aggregate total of 15,000 acres as farmland and/or open space.. Income criteria: Farming or agricultural activities on the land must have contributed to a gross annual farming income of at least $2,000 per year in 1 of the 2, or 3 of the 5, calendar years preceding the date of application for classification. The farming or agricultural activity and income derived from that activity may be achieved by either the owner or a lessee of the land. Gross income includes the value of commodities produced for consumption by the farm household.
Local Option Agricultural Conservation Easement
Preferential treatment: In granting the municipality an agricultural conservation easement, the municipality provides an annual farm support payment of up to 100% of the annual property taxes assessed by the municipality against the land and buildings subject to the easement..
