Agricultural Value Assessment
Preferential treatment: Use value is based upon income-producing capability and comparable sales of farmland purchased for farm purposes where the price is indicative of farm use value, excluding sales representing purchases for farm expansion, better accessibility, and other factors which inflate the purchase price beyond farm use value.. Penalty: While Kentucky does not currently impose a penalty for a change of use, the Kentucky Constitution states that the General Assembly may levy an additional tax when land changes from agricultural or horticultural use to another use. The additional tax may not exceed the additional amount that would have been owed had the land been assessed at its fair cash value for the current year and the 2 next preceding years. When land that is valued and taxed as agricultural or horticultural land is converted to any other use after 1 January of the tax year, that portion of the land upon which the use is changed is subject to tax for the succeeding tax year at its fair cash value. At the time of a land use change, the owner of the property must report the change to the property valuation administrator within 90 days.. Eligible land uses: Agricultural/Farmland, Forest Land/Timber Production, Other Land Uses. Eligibility: Plot/Land Size. Plot criteria: Agricultural land must be a minimum of 10 acres. Horticultural and aquacultural land must be a minimum of 5 acres. In determining the total area of land devoted to agricultural or horticultural use, the area of all land under farm buildings, greenhouses and like structures, lakes, ponds, streams, irrigation ditches and similar facilities, and garden plots devoted to the growth of products for on-farm personal consumption is included. However, the land used in connection with dwelling houses includes lawns, drives, flower gardens, swimming pools, other areas devoted to family recreation, etc. is excluded.. Income criteria: None
