Agricultural Land
Preferential treatment: In Maui and Kaua'i County, dedicated lands are valued according to current use if dedicated for 10 years or valued at 50% of current use if dedicated for 20 years. In Hawai'i County, dedicated lands are valued according to current use. In addition, dedicated native forest lands are valued at 50% of the lowest dedicated agricultural use value category. In Honolulu County, land dedicated to agricultural use for 5 years is assessed at 3% of its fair market value; 1% of fair market value if dedicated for 10 years; and 1% of fair market value if dedicated for either 5 or 10 years in the case of pastureland. Each county has separate tax rates for agricultural properties.. Penalty: In all counties, rollback taxes, recapture, or loss of preferential valuation upon breach of dedication. In each county, a rollback tax of the difference between the amount of taxes paid and what would have been due without the lower assessment rate is payable with a 10% annual penalty.. Eligible land uses: Agricultural/Farmland, Forest Land/Timber Production, Other Land Uses. Eligibility: Plot/Land Size, Location, Prerequisite Designation or Certification, Management Plan, Prior Year's Land Use, Multi-Year Commitment. Plot criteria: In Kaua'i County, areas less than 100 acres must be entirely in cultivation and/or production when a petition is filed. For plots that are 100 acres or more, the larger of (1) 100 acres or (2) 50% of the area must be in cultivation and/or production when a petition is filed. Any areas that exceed the 100 acre or 50% requirement, but are not yet in cultivation and/or production, shall be planted at a rate of 10% per year and each subsequent year.
