Farmland Preservation (PA 490)
Preferential treatment: The present true and actual value of land classified as farm land is based upon its current use without regard to neighborhood land use of a more intensive nature, provided that the present true and actual value of open space land is less than it would be if it comprised a part of a tract of land classified as farm land.. Penalty: If the owner sells, transfers or changes the use of farm land within 10 years from the time of the acquisition of the title to such land or from the time of classification of such land as farm land, whichever is earlier, a conveyance tax is levied applicable to the total sales price of such land, or, in the case of a change of use without sale, the fair market value of the property as determined by the assessor in conjunction with the most recent revaluation. The tax is 10% of sales or fair market price if the transfer or change in use occurs within the 1st year of ownership or classification and decreases 1% per year.
